More motions and responses have been filed this week in connection with the capital murder trial of Adam Longoria. The Great Bend man is scheduled to appear in Barton County District Court this morning for a pre-trial hearing.

Longoria, 36, is charged with capital murder and sodomy in the death of 14-year-old Alicia DeBolt, Great Bend.

Previous motions filed by the Attorney General Steve Six for the State of Kansas and by attorneys Jeffrey Wicks and Tim Frieden with the Kansas Death Penalty Defense Unit have dealt with Longoria’s marital status at the time of DeBolt’s death. Longoria claimed Eva Brown as his common law wife, and invoked the spouse/marital privilege, which means statements to her would be inadmissible in court. However, the defense revised its position with a motion filed Monday. After further consultation with his attorneys, Longoria "no longer asserts that he and Eva Brown were common law married and withdraws his previous response."

On Monday the state also filed a response to defense’s motion seeking a standing order that would allow attorneys to file motions under seal — closed to public view — without first getting a court order. The state is opposed to the proposal. In his response, Attorney General Six wrote, "The State is aware of the high public interest in this case. However, a standing order would frustrate the goal expressed in K.S.A. 60-2617 of providing public access to the court record unless there is good cause shown." (The statute cited says the court "shall recognize that the public has a paramount interest in all that occurs in a case, whether at trial or during discovery and in understanding disputes that are presented to a public forum for resolution." It goes on to say records may be sealed or redacted (partially hidden) if a good reason exists that outweighs the strong public interest.
