The State’s pending motion to try the juvenile accused of first-degree murder in the death of Great Bend 14-year-old Rubi Perez as an adult remains unruled following a hearing in Barton County District Court.
Parties appeared via Zoom before 20th District Judge Levi Morris in the Barton County Courthouse for a scheduling hearing Tuesday afternoon that included Barton County Assistant Attorney Rita Sunderland for the State, with Wichita attorney Jesse Hoeme for the defense.
At the hearing, Hoeme noted that the parents of the victim had yet to receive a mailed copy of the State’s motion and requested additional time to prepare, Hoeme also asked for items that had not been received in the discovery process.
In granting the continuance, Judge Morris set the next hearing dates as Aug. 26 and 27.
Under Kansas law, filed motions yet unruled result in the juvenile remaining in the juvenile justice system that includes non-disclosure of certain records to protect the identity of the accused.
