LARNED – Michael Patrick Stacey, 19 of Larned, appeared in custody Thursday afternoon before Magistrate Judge Ken Schmidt in Pawnee County District Court. Stacey is charged with one count of rape of a victim overcome by force or fear and one count of battery.

Pawnee County Attorney Douglas McNett said the crimes involve a single incident alleged to have occurred in Pawnee County on or about October 25. The Larned Police Department handled the investigation.

At the first appearance on Thursday, Judge Schmidt advised the defendant of the charges, the possible penalties if convicted and his constitutional rights, including his right to counsel. If convicted, under the Kansas Sentencing Guidelines the defendant faces a presumptive prison sentence between 147 months and 653 months in the custody of the Department of Corrections, depending on his criminal history.

Stacey was arrested on Tuesday, November 12, without incident and is being held in the custody of the Pawnee County Sheriff in lieu of $100,000 bond.  A preliminary hearing has been scheduled for December 3.
